Texas Defensive Driving for Ticket Dismissal: Who Qualifies (2026)

Aug 2, 2026

Texas handles this differently from most states. A court approved driving safety course gets the citation dismissed, so there is no conviction and no points to worry about. The catch is that the eligibility rules are narrow, and a few common situations rule you out entirely.

The once per 12 months rule

You cannot use a driving safety course for dismissal if you completed one in the previous 12 months. The period is measured from the date you completed the previous course to the violation date of your current citation, so check both dates before assuming you qualify.

What disqualifies you

These are the ones that catch people out:

  • Speeding 25 mph or more over the posted limit. Above that threshold the option is gone.
  • Speeding in excess of 95 mph, regardless of the limit.
  • A construction or work zone violation with workers present.
  • Offenses that are not Class C misdemeanor traffic offenses.
  • Having completed a course for dismissal within the previous 12 months.

What you need to qualify

  • A valid Texas driver license or permit, or current military status.
  • Proof of insurance that lists you as a covered driver. Not simply a policy on the vehicle, but one showing you personally as covered.
  • The offense must be a Class C misdemeanor traffic offense.
  • Court permission, requested by the deadline on your citation.

Multiple tickets from one stop

If a single traffic stop produced more than one citation, for example speeding plus a seatbelt violation, only one of them can be dismissed by taking the course. You cannot clear the whole stop with one class, so if you have a choice, apply it to the citation that carries the heavier consequence.

The order to do it in

  1. Request permission from the court named on your citation before the due date. Do not simply take a course and present it afterwards.
  2. Provide your license and proof of insurance showing you as a covered driver.
  3. Take a course approved by the Texas Department of Licensing and Regulation.
  4. Submit the completion certificate and your driving record to the court by the deadline it sets.

Because dismissal means no conviction is entered, there is no point to mask and nothing for an insurer to rate against from that citation.

This is general guidance, not legal advice. Texas driving safety course rules are set in statute and administered by individual courts, and the legislature revisits them periodically, so requirements and deadlines can change. Confirm with the court named on your citation and with the Texas Department of Licensing and Regulation before deciding.

Frequently asked questions

How often can I take defensive driving in Texas?

Once every 12 months for dismissal purposes. The period runs from the date you completed the previous course to the violation date on your current citation.

Can I take defensive driving for any speeding ticket in Texas?

No. You are not eligible if you were speeding 25 mph or more above the posted limit, or in excess of 95 mph. Work zone violations with workers present are also excluded.

What do I need to qualify in Texas?

A valid Texas driver license or permit, or current military status, plus proof of insurance that lists you specifically as a covered driver. The offense must be a Class C misdemeanor traffic offense and the court must grant permission.

I got two tickets in one stop. Can I dismiss both?

No. Only one citation from a single stop can be dismissed by taking a course, so apply it to whichever citation carries the more serious consequence.

Does defensive driving remove points in Texas?

There is nothing to remove, because the citation is dismissed rather than masked. No conviction is entered, so no points arise from it in the first place.

Do I need the court's permission first?

Yes. Request permission by the deadline on your citation rather than completing a course and presenting it afterwards, because a course taken without approval may not count.
